CNN —An attorney discipline judge in California has rejected a request from ex-Trump election lawyer John Eastman to reactivate his law license following her recent recommendation that he be disbarred, which rendered him unable to practice law for now. Judge Yvette Roland, who oversees state bar proceedings in California, recommended in March that Eastman be disbarred for his election subversion efforts. The California Supreme Court will ultimately decide whether to endorse or reject Roland’s recommendation to disbar Eastman. “Eastman failed to uphold his primary duty of honesty and breached his ethical obligations by presenting falsehoods to bolster his legal arguments,” Roland wrote in her opinion recommending he be disbarred. He also was indicted last month in Arizona in connection with efforts to overturn the 2020 election, along with more than a dozen other Trump allies, including Mark Meadows and Rudy Giuliani.

Eastman is asking a judge in California to reactivate his license following a disciplinary decision last month that rendered him unable to practice law for now. That decision prompted his law license to be made inactive over the weekend, meaning he can’t have legal clients while he appeals the decision. Until his law license was made inactive, Eastman represented about a half-dozen clients on constitutional issues, including relating to elections. Those prominent clients are now going to bat for him in his request to continue his legal work. The ethics charges that were brought against Clark by the DC Bar’s Office of Disciplinary Counsel allege that he was dishonest and attempted to interfere with the administration of justice after the 2020 election. An attorney for Clark at the trial attempted to highlight how Clark was working on the behalf of the then-president after the election. CNN —An attorney discipline judge in California has recommended that ex-Trump election lawyer John Eastman be disbarred, according to an opinion released on Wednesday. Judge Yvette Roland’s opinion comes after a lengthy trial about Eastman’s actions as he led some of the efforts for Donald Trump to challenge his 2020 election loss. The opinion serves as a recommendation to the California Supreme Court, which will ultimately decide whether to endorse or reject the punishment. Eastman will have the opportunity to appeal Roland’s ruling. LOS ANGELES (AP) — A judge has recommended that conservative attorney John Eastman lose his California law license over his efforts to keep former President Donald Trump in power after the 2020 election. State Bar Court of California Judge Yvette Roland's recommendation, issued Wednesday, now goes to the California Supreme Court for a final ruling on whether he should be disbarred. The California State Bar is a regulatory agency and the only court system in the U.S. that is dedicated to attorney discipline. Eastman has been a member of the California Bar since 1997, according to its website. He ran for California attorney general in 2010, finishing second in the Republican primary.

A judge in California recommended on Wednesday that the lawyer John Eastman be stripped of his law license, finding he had violated rules of professional ethics by persistently lying in his efforts to help former President Donald J. Trump maintain his grip on power after losing the 2020 election. In a 128-page ruling, the judge, Yvette Roland, said Mr. Eastman had willfully misrepresented facts in lawsuits he helped file challenging the election results and acted dishonestly in promoting a “wild theory” that Mr. Trump’s vice president, Mike Pence, could unilaterally declare him the victor during a certification proceeding at the Capitol on Jan. 6, 2021. “In sum, Eastman exhibited gross negligence by making false statements about the 2020 election without conducting any meaningful investigation or verification of the information he was relying upon,” Judge Roland found, adding that he had breached “his ethical duty as an attorney to prioritize honesty and integrity.”

The ruling was not related to a defense effort to disqualify Fani T. Willis, the district attorney of Fulton County, Ga., who is leading the case. Atlanta CNN —Former President Donald Trump’s attorneys in the Georgia election subversion case are set to defend their client in a Fulton County courtroom for the first time on Friday as they try to have the charges thrown out on First Amendment grounds. This is the first time Trump’s attorneys will appear in court in the Fulton County case, though their client won’t be with them. Trump hasn’t yet been in the Atlanta courthouse – he previously waived his right to an arraignment hearing – though he was processed at the Fulton County jail in late August. She used a similar legal strategy in a 2014 RICO case in Fulton County, according to a source familiar with the matter. Despite his mounting legal debt and the fact that he is almost 80, sources close to Giuliani said he intends to fight the Georgia case.

ATLANTA (AP) — Some Republican lawmakers continued to press Wednesday for changes to protect Georgia's voting system from security weaknesses, but a deputy to Secretary of State Brad Raffensperger accused them of acting in bad faith and promoting lies that Georgia's 2020 election was stolen from Donald Trump. The dispute with some Republicans in the state Senate stems from vulnerabilities in Dominion Voting Systems equipment identified by J. Alex Halderman, an expert witness in a lawsuit challenging the constitutionality of Georgia’s election system. However, they say it's impractical to update all 40,000 electronic voting machines and scanners statewide before the 2024 election cycle begins. Senate Ethics Committee Chairman Max Burns, a Sylvania Republican, said at the end of the hearing he wanted to see changes. With so many lawyers involved in the Watergate criminal scheme, the American Bar Association started requiring law schools to provide ethics instruction or risk losing their accreditation. In Fulton County, Ga., three of former President Donald Trump’s lawyers — Kenneth Chesebro, Sidney Powell and Jenna Ellis — have now pleaded guilty to crimes in service of Mr. Trump’s scheme to overturn the 2020 election and stay in the White House. All three have agreed to cooperate with prosecutors in the sprawling state RICO case against Mr. Trump. Two other Trump lawyers, Rudy Giuliani and John Eastman, still face criminal charges in the Georgia case. If Mr. Trump’s 2020 racket was “a coup in search of a legal theory,” as one federal judge put it, these lawyers provided the theory, and the phony facts to back it up.

(CNN) – Fulton County prosecutors have discussed potential plea deals with at least six additional co-defendants charged alongside Donald Trump for attempting to subvert the 2020 presidential election, multiple sources tell CNN. Pro-Trump lawyer Robert Cheeley is among those who have been offered a plea deal in the Georgia case but, according to his lawyer, turned it down. A source with knowledge of the Fulton County DA’s strategy tells CNN that it would be open to discussing plea deals with anyone, but there is little room for compromise when it comes to the charges against Trump. To be clear, there is no indication that prosecutors or Trump’s legal team are interested in discussing a plea deal. John Eastman, who is also considered one of Trump’s most high-profile co-defendants, has not been offered a plea deal either, his lawyer told CNN.

The electors scheme became a vital part of the end game strategy pursued by Mr. Trump as he and his allies sought to find a way to block or delay congressional certification of his Electoral College defeat. Fulton County prosecutors recommended that he serve 5 years of probation and pay $5,000 in restitution, and Fulton County Superior Court Judge Scott McAfee imposed that sentence at Friday’s hearing. Three defendants have now pleaded guilty in the sprawling racketeering case: Chesebro, Powell and Georgia-based bail bondsman Scott Hall. Powell and Hall both admitted their roles in the January 2021 breach of election systems in rural Coffee County, Georgia. Justice Clarence Thomas was not involved in considering or deciding Eastman's request that the Supreme Court toss lower court rulings related to the emails, the court said in declining to hear the case. Thomas' recusal, which was not explained, is the first time he has removed himself from a case involving the Jan. 6 insurrection by a mob of supporters of former President Donald Trump.

In decisions in 2022, U.S. District Court Judge David Carter in Santa Ana ordered certain emails to be turned over, including those related to court efforts by Trump and Eastman to delay congressional certification of Biden's victory. Carter ruled that Trump and Eastman had "more likely than not" committed a crime in trying to obstruct Congress. Eastman has sought to erase the judge's determination that the "crime-fraud" exception applied to some of the emails. Trump is the frontrunner for the Republican nomination to face Biden in the 2024 election.
